Uristic Discussions on the Categories of Testimony and Their Contemporary Application: A Research Study in the Light of Al-Muhalla by Ibn Hazm and Al-Hidayah by Burhan al-Din al-Marghinani

Abstract

Testimony occupies a central position in Islamic jurisprudence as an essential means for establishing justice, protecting human rights, and maintaining social order. The Qur’an and Sunnah have laid down comprehensive principles regarding testimony, its categories, conditions, and legal implications. Muslim jurists further elaborated these principles in classical works of fiqh, developing a rich legal discourse on the subject. Among the most authoritative works in this regard are المحلیٰ by Ibn Ḥazm and الہدایہ by Burhān al-Dīn al-Marghīnānī. These works represent two significant juristic traditions and provide detailed discussions on the various categories and principles of testimony.

This study, titled “Juristic Discussions on the Categories of Testimony: An Analytical Study in the Light of al-Muḥallā by Ibn Ḥazm and al-Hidāyah by al-Marghīnānī,” aims to examine the major categories of testimony and their juristic foundations in the light of these classical sources. The research highlights the legal significance, conditions, and essential elements of testimony while exploring the methodological approaches adopted by both scholars. Furthermore, the study seeks to demonstrate the importance of Islamic legal thought in establishing justice and regulating judicial procedures within society. The research adopts an analytical and descriptive methodology to present a comprehensive understanding of the subject and to underline the scholarly value of these classical juristic works.
